Terms of Service

1. The service

Neverapply Social (“the Service”, “we”, “us”) is a cloud social-media scheduling platform available to the public. Independent creators, agencies and businesses can create an account, connect social accounts they own or are authorized to manage, plan and schedule original content, upload drafts or publish posts through the official APIs of supported platforms (including TikTok, Instagram, Facebook Pages, Threads, LinkedIn, X and others), and view publishing status and account analytics. 2. Accounts and eligibility

You must be at least 18 years old, or the age of majority where you live, to create an account.
You are responsible for keeping your login credentials confidential and for all activity in your workspace.
You must provide accurate registration information and keep it current.
If you use the Service on behalf of a company or a client, you confirm that you are authorized to bind them to these Terms.

3. Your workspace

Each customer controls an independent workspace. Your connected accounts, posts, media, schedules and settings are visible only to you and to teammates you invite. We do not access, edit or publish your content except to operate the Service (for example, to deliver a post at the time you scheduled) or as required by law.

4. Connected social accounts

You may connect only social accounts that you own or are explicitly authorized to manage (for example, a client’s account under a written agreement).
Connecting an account happens through the platform’s own login and permission screens. You can disconnect an account in the Service at any time and revoke access in the platform’s settings.
You must comply with each platform’s terms and community guidelines, including the TikTok Terms of Service, Community Guidelines and Developer Terms, and Meta’s Platform Terms, when publishing through the Service.

5. Acceptable use

You agree not to use the Service to:

publish content you do not have the right to publish, or content that infringes intellectual-property, privacy or publicity rights;
publish spam, misleading, deceptive, hateful, harassing, sexually explicit or otherwise unlawful content, or content that violates a platform’s policies;
connect or operate accounts you are not authorized to manage, buy or sell engagement, or run automated or coordinated inauthentic behaviour;
attempt to circumvent platform rate limits, review processes or security controls, or to reverse-engineer, scrape or disrupt the Service;
upload malware or content that is harmful to minors.

We may remove content, disconnect accounts, or suspend or terminate a workspace that violates these Terms or a platform’s policies.

6. Content and licence

You keep all rights to the content you upload. You grant us a limited, non-exclusive licence to store, process and transmit that content solely to provide the Service (for example, to deliver it to a platform you scheduled it for). We do not claim ownership of your content and do not use it for advertising or to train models.

7. Publishing behaviour

Posts are delivered at the time you schedule, subject to platform availability. Where a platform offers it, you can choose to upload a draft to the platform’s app for you to review and publish there, or to publish directly.
Platform APIs may reject, delay or alter a post (for example, because of media requirements or policy checks). The Service shows the status returned by the platform; you remain responsible for the content.

8. Fees

The Service is currently offered free of charge. If paid plans are introduced, prices and terms will be published before they apply to you, and you will be able to cancel before being charged.

9. Termination

You may delete your workspace at any time from the settings or by emailing us. We may suspend or terminate access for violation of these Terms, for legal reasons, or if the Service is discontinued, with reasonable notice where possible. On termination, your connected-account tokens are deleted and your content is removed in line with our Privacy Policy.

10. Disclaimers and liability

The Service is provided “as is” and “as available”. We do not guarantee that a platform will accept or deliver every post, or that analytics are complete. To the extent permitted by law, we are not liable for indirect or consequential loss, lost profits, or for actions taken by a third-party platform against your accounts. Our total liability for any claim is limited to the amount you paid us for the Service in the twelve months before the claim (or €100 if you paid nothing).

11. Changes

We may update these Terms. Material changes will be announced on this page with a new “last updated” date, and, where we have your email, by notice to it. Continued use after the change means you accept the new Terms.
